Mary Pop’ins Terms and Conditions

1. General Overview

By accessing and using Mary Pop’ins services, website, and products, you agree to comply with these Terms and Conditions. If you do not agree, please refrain from using our services.

2. Product Customization and Design

2.1 Artwork and Custom Designs
   •    All artwork and designs provided by Mary Pop’ins, including hand-drawn, custom-printed, or digital designs, are the intellectual property of Mary Pop’ins.
   •    Clients may not reproduce, distribute, or modify the designs without prior written consent from Mary Pop’ins.
   •    Any customization or personalization requested by the client will be reviewed and approved before production begins. Once approved, changes cannot be made.

2.2 Approval Process
   •    Custom designs will be shared with the client for approval before production. The client must confirm in writing (via email or designated platform) that they are satisfied with the design.
   •    Approval constitutes final confirmation, and Mary Pop’ins will not be held liable for any errors noticed after production has started.

2.3 Design Ownership
   •    All custom designs remain the exclusive property of Mary Pop’ins. Clients are granted a single-use license for personal use only (e.g., for nursery decoration).
   •    Mary Pop’ins reserves the right to use the designs for promotional or portfolio purposes unless explicitly prohibited in writing by the client.

3. Orders and Payment Terms

3.1 Payment Plans
   •    A 50% non-refundable deposit is required at the time of placing an order. The remaining balance is due before delivery or pickup.
   •    Payment plans are available through Payflex or as agreed upon directly with Mary Pop’ins.

3.2 Order Confirmation
   •    Orders are considered confirmed only after receipt of the deposit and approval of all customization details.
   •    Any delays in payment or approval may result in extended production timelines.

3.3 Lead Time
   •    The standard lead time for customized orders is 6–8 weeks. Rush orders may incur an additional fee and must be explicitly requested.

3.4 Payment Methods
   •    SMS bank confirmations and WhatsApp verifications will no longer be accepted as proof of payment. Only official payment receipts or bank confirmations via email will be acknowledged.
   •    Failure to provide the correct payment confirmation may result in delays to your order processing.

4. Refund and Return Policy

4.1 Non-Refundable Deposit
   •    The initial 50% deposit is non-refundable under any circumstances, as it covers materials and design work already undertaken.

4.2 Returns and Exchanges
   •    Customized and personalized products cannot be returned or exchanged unless they are defective or significantly differ from the approved design.
   •    Before a credit or refund is issued, Mary Pop’ins must be given the opportunity to rectify any reported issues with the product.
   •    To request a return or exchange, clients must contact Mary Pop’ins within 7 days of receiving the product, providing photographic evidence of the defect.

4.3 Refunds
   •    Refunds are only applicable in cases where:
   •    A product is proven defective or damaged during shipping.
   •    Mary Pop’ins fails to deliver the agreed product after the confirmed lead time, without valid reasons or communication.

4.4 Refund Exemptions
   •    Refunds will not be provided for the following:
   •    Minor variations in color or texture (e.g., due to screen-to-print discrepancies).
   •    Buyer’s remorse or change of mind after production has started.
   •    Incorrect details provided by the client, including misspellings, incorrect measurements, or inaccurate instructions.

4.5 Process for Refunds
   •    Approved refunds will be processed within 14 business days. The method of refund will depend on the original payment method.

5. Shipping and Delivery

5.1 Shipping Costs
   •    Shipping costs are calculated based on the size, weight, and destination of the order. These costs will be included in the final invoice.

5.2 Delivery Timeframes
   •    Delivery times may vary depending on location. Mary Pop’ins will not be held responsible for delays caused by courier services or customs clearance.

5.3 Risk of Loss
   •    Once the product is handed over to the courier, the risk of loss or damage passes to the client. Insurance can be arranged upon request.

6. Client Responsibilities

6.1 Accuracy of Information
   •    Clients are responsible for providing accurate information regarding customization, delivery addresses, and contact details.
   •    Mary Pop’ins will not be liable for delays or issues caused by incorrect information provided by the client.

6.2 Care Instructions
   •    Care instructions are provided for all items, except products with stuffing that do not have zips and sponges, such as baby nests and braided bumpers.
   •    Clients must follow the care instructions provided. Mary Pop’ins is not responsible for damage caused by improper cleaning or handling.

7. Intellectual Property

7.1 Mary Pop’ins Branding
   •    All branding elements, including logos, taglines, and product names, are owned exclusively by Mary Pop’ins.
   •    Unauthorized use of Mary Pop’ins intellectual property is strictly prohibited.

7.2 Artwork Rights
   •    Designs created for specific clients may be featured in Mary Pop’ins portfolio, promotional materials, or social media.
   •    Clients can request in writing that their designs remain private, subject to approval by Mary Pop’ins.

8. Order Placement and Correspondence
   •    Once a design has been approved, no further changes, add-ons, or special specific instructions will be accepted via voice
